Terms and Conditions for Sarah Fingarson Photography

Effective Date: January 1, 2025

These Terms and Conditions (“Agreement”) govern your use of Sarah Fingarson Photography’s services (“we,” “our,” or “us”), a professional photography business operating under Sarah Fingarson Photography LLC in the state of Washington. By hiring us for photography services or by using our website, you agree to be bound by the terms set forth below.

1. General Terms

1.1. Agreement Acceptance:
By booking our services, you agree to be bound by these terms and conditions.

1.2. Amendments:
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page, and you will be notified of material changes.

2. Services Provided

2.1. Photography Services:
Sarah Fingarson Photography provides professional photography services for weddings, portraits, events, and other photography needs. A detailed list of services, packages, and pricing is available on our website or upon request.

2.2. Deliverables:
Upon completion of the photography session, clients will receive edited, high-resolution digital images. Additional products, such as photo albums, prints, or canvas enlargements, may be purchased separately.

2.3. Travel Fees:
For events or sessions outside of Seattle, Washington, additional travel fees may apply. Travel fees will be discussed and agreed upon in advance.

3. Booking & Payments

3.1. Booking Confirmation:
To confirm your booking, a signed contract and non-refundable deposit of 25% are required.

3.2. Payment Terms:
Full payment for photography services is due 30 days prior to the event date. Payments can be made via Visa, Mastercard, Venmo, Zelle, Cash or personal check. 

3.3. Late Payments:
A late fee of $150 will be applied to payments not received by the due date.

4. Cancellation & Rescheduling Policy

4.1. Client Cancellations:
If you need to cancel or reschedule your booking, please notify us as soon as possible. Cancellations made 90 days prior to the event are subject to a cancellation fee of $250. 

4.2. Photographer Cancellation:
In the rare event that we need to cancel due to unforeseen circumstances, we will provide a full refund of all fees paid, and we will assist in finding an alternative photographer if requested.

5. Intellectual Property

5.1. Copyright:
All images and photographs created by Sarah Fingarson Photography are protected by copyright laws. We retain full ownership of all images and grant clients a limited license to use the images for personal, non-commercial purposes. Commercial use of images requires prior written consent.

5.2. Image Use:
You may share your images on social media or for personal use but must credit Sarah Fingarson Photography if applicable. We reserve the right to use any images from your session for promotional purposes, including but not limited to our website, social media, and advertising.

6. Client Responsibilities

6.1. Access & Cooperation:
Clients agree to cooperate and provide necessary access to locations, props, or other elements needed for the photoshoot. This includes arranging for permits or permissions where required.

6.2. Model Release:
By hiring Sarah Fingarson Photography, you grant us permission to use the photographs for promotional purposes, unless otherwise agreed in writing.

7. Limitations of Liability

7.1. Event Delays or Cancellations:
We are not responsible for delays, cancellations, or other issues arising due to factors beyond our control, including inclement weather, accidents, or venue restrictions.

7.2. Image Quality:
We will make every effort to ensure high-quality images; however, we are not responsible for conditions that may affect image quality, including but not limited to lighting, weather, or location conditions.

8. Miscellaneous

8.1. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the State of Washington.

8.2. Dispute Resolution:
Any disputes arising from this Agreement shall be resolved through Sarah Fingarson, or in the courts of Seattle, Washington.

8.3. Severability:
If any provision of this Agreement is deemed invalid or unenforceable, the remainder of the Agreement will remain in full force and effect.
